Terms of service

1. Scope of Application

These Terms and Conditions (T&Cs) apply to all orders placed through our online shop. The operator of the online shop is:

Arte Popular Latino
Manuel Patrick Alfonso Ulrich
Lindenstraße 84
50674 Cologne, Germany
Email: info@artepopularlatino.eu

2. Contract Partner and Conclusion of Contract

The purchase contract is concluded with Arte Popular Latino, represented by Manuel Patrick Alfonso Ulrich.
The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to place an order. By submitting your order, you make a binding offer to conclude a purchase contract. The contract is only concluded when we explicitly confirm your order via email or by shipping the goods.

3. Prices and Payment Terms

All prices in the online shop are listed in Euros and include statutory VAT.
For deliveries to non-EU countries, additional customs duties, taxes, or fees may apply, which are the responsibility of the customer.
The available payment methods are displayed during the ordering process.

4. Shipping Conditions

Shipping is carried out to the delivery address provided by you. Shipping costs are displayed separately during the ordering process.
The risk of accidental loss or deterioration of the goods transfers to the customer upon handover to the shipping company.

5. Delivery Times

The delivery time is usually 3–7 business days unless otherwise specified. If we are unable to meet the agreed delivery time due to force majeure or unforeseen obstacles (e.g., delays by suppliers), we will inform you promptly.

6. Exchanges

The fastest way to receive the desired item is to return the original item and place a new order.

7. Retention of Title

The goods remain our property until full payment has been received.

8. Warranty and Liability

The statutory warranty rights apply. The warranty period is 24 months from the delivery date.
Liability for damages to life, body, and health, as well as in cases of gross negligence or intent, remains unaffected.

9. Data Protection

We treat your personal data confidentially and in accordance with statutory data protection regulations. For information on how we process your data, please refer to our Privacy Policy.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can access at https://ec.europa.eu/consumers/odr/.
We are willing to participate in an out-of-court dispute resolution procedure.

11. Governing Law

The laws of the Federal Republic of Germany apply. Mandatory consumer protection regulations of the country in which you have your habitual residence remain unaffected.

12. Severability Clause

Should any provision of these T&Cs be invalid, the remainder of the contract remains valid. The invalid provision will be replaced by the applicable statutory provisions.
